Used in the acknowledgment recital and to validate the sublease window sits inside the master term.
Hard ceiling: a sublease cannot extend past this date.
Sublease term
Enter the sublease start date.
The move-in date. Must fall on or after the master start. Defaults to today.
Enter the sublease end date.
The move-out date. Must be after the start and on or before the master end.
Rent & deposit
Enter the monthly rent (a number greater than $0).
The core economic term. Printed in the rent clause and used for the term-total estimate.
1–31. The clause prints this verbatim, plus "or the last day of the month if shorter." Defaults to 1.
Reduces disputes over how/where rent is paid. Defaults to "bank transfer / Zelle."
Leave blank to default to one month's rent. Validated against CA / NY caps (1 month).
Utilities & late fee
Allocating utilities prevents a top dispute area.
Only used when "Partial" is selected. The rest are billed to the sublessee.
Optional and safest left blank. Many states cap late fees. Enter a dollar amount or a percent of rent.
Days after the due date before the late fee applies. Only used if a late fee is set.
Landlord consent
This is the single biggest enforceability risk. "Need to request it" appends a separate Landlord Consent Addendum for the landlord to sign.

What it does

This tool builds a clause-complete, copy/paste-ready residential sublease agreement from a short form. It assembles the title and agreement date, the party blocks (sublessor and sublessee), a recital acknowledging your original/master lease and incorporating it by reference, the premises and scope (entire unit vs. private room), the term, the rent (amount, due day, method, plus an estimated term total), the security deposit and return terms, utilities allocation, an optional late-fee clause, use/occupancy and no-further-subletting terms, a clause keeping the sublessee bound by the master lease while the sublessor stays liable to the landlord, an optional furnishings/condition clause, default and termination tied to the master lease, the governing-law clause, an entire-agreement clause, and signature blocks. It also adds a landlord-consent block or a separate Landlord Consent Addendum depending on your consent status. How to use it

  1. Pick the governing state and enter the sublessor, sublessee, and premises address.

A worked example

Suppose Jordan is subletting the entire unit at 123 Oak St, Thousand Oaks, CA, to Sam. The master lease runs Jan 1, 2026 → Dec 31, 2026. The sublease runs Jul 1, 2026 → Oct 1, 2026 at $1,800/month, deposit left blank (so it defaults to one month = $1,800), and Jordan still needs to ask the landlord, so consent status is "Need to request it." The tool computes:

Term length  = Jul 1 → Oct 1, 2026 = 3 months, 0 days  (92 days)
Total rent   ≈ 1800 × (92 / 30.4375) = 1800 × 3.0226… → $5,441  (estimate)
Deposit      = blank → defaults to 1 month = $1,800
Deposit cap  = CA → 1 × rent = $1,800  → $1,800 is within the cap ✓
Consent      = Need to request → Landlord Consent Addendum appended

The readiness banner reads "Sublease ready: 3 months, $1,800/mo, deposit $1,800 — landlord consent addendum included." Because Jul 1 ≥ Jan 1 and Oct 1 ≤ Dec 31, the term-containment check passes and the export unlocks. If you had set the sublease to end Jan 15, 2027 — past the master end — the tool would block generation with "A sublease cannot run outside the dates of your original lease."

What is a sublease agreement and what must it include?

A sublease agreement is a contract by which the original tenant (the sublessor) rents out the leased premises — the whole unit or a single room — to a new occupant (the sublessee) for part or all of the remaining lease term. To be enforceable it should name both parties, identify the premises by address, reference the original/master lease and its dates, state the sublease term, the rent and how it is paid, the security deposit, who pays utilities, and acknowledge that landlord consent may be required. This free tool fills all of those clauses, validates the term against your master lease, and produces a printable agreement plus a landlord-consent block.

Do I need my landlord's permission to sublet?

Almost always. Most residential leases either prohibit subletting outright or require the landlord's prior written consent. Where a lease is silent, many states apply a default rule allowing a sublet subject to the landlord's reasonable consent — but a written ban generally controls, and subletting in violation can be grounds for eviction. Get consent in writing; an oral "okay" is hard to prove and may still breach a written-consent clause. This tool can generate a separate Landlord Consent Addendum for the landlord to sign.

Can a sublease end after my original lease ends?

No. A sublease cannot run outside the dates of your master lease. You cannot grant a right of occupancy you do not hold — a sublease that ends after the master lease ends is effectively an assignment or a holdover, not a sublease. This tool enforces that as a blocking rule: the sublease start must fall on or after the master lease start, and the sublease end must fall on or before the master lease end, or it will not let you generate the document.

Does subletting release me from my lease?

No. The sublessor (the original tenant) remains fully liable to the landlord under the master lease for rent, damage, and lease violations — including those caused by the sublessee. A sublease does not transfer your obligations or release you; it just adds an occupant who pays you. If the sublessee stops paying or damages the unit, the landlord can still come after you. The agreement makes the sublessee responsible to you and bound by the master lease, but your name stays on the original lease.

How much security deposit can I charge a subtenant?

It depends on the state. California (effective July 1, 2024) and New York (2025) generally cap residential security deposits at one month's rent, and both require the deposit to be returned within 21 days of move-out. Other states range roughly from 14 to 60 days for return and may or may not cap the amount. This tool warns — but does not block — when your deposit exceeds the known cap for California or New York; it treats its state table as a dated convenience, not legal authority, because the law changes and some small-landlord exceptions apply.
